Discrimination, Harassment & Disability Cases
Have you become disabled and want to know what your employment rights are under the law? Have you suffered sexual harassment and been ignored by your employer's human resources department? Are you taking a maternity leave and concerned if your job will be held for you upon your return? Have you been downsized, laid off, or demoted during a corporate restructuring, noticing your employer replaced you with, retained, or promoted employees younger than you?
Rubin Law will take the time to advise you while you are still employed, explaining how to approach your human resources department and help you position yourself to achieve your career goals. This may mean confronting your employer, negotiating workplace restrictions or considering a buyout. For example, we recently handled a case in which a woman who was an executive in the entertainment industry announced she was taking maternity leave. She had been in line for a promotion to a Vice Presidency. Instead of keeping her on that track, the company announced a "reorganization" in which a new position for VP would be created and staffed through an outside interviewing process, and her position would be eliminated. With our advice, this executive was able to battle back this situation so that her position with the Company was preserved after an investigation into unlawful employment practices was launched against her supervisors. In another case, a female executive was being forced out amid a reorganization in which the number of retirement packages available was evidently exhausted. Her management chose to make up performance issues as a way of pushing her out without compensation. Through our negotiations, she was able to obtain a generous severance package, and good references, amid circumstances where the company had previously sought to fabricate performance issues.
If you have already been wrongfully terminated, we can advise you of your rights and next steps, and determine if your interests are best served by negotiation, mediation or litigation. We will also help you build a strategy in order to leave your career options open.
